This contract has as its object the purchase and sale of products marketed by www.ciprianitartufi.it in the quantity and quality chosen by the consumer through electronic selection on the site.
From the moment the consumer accesses and uses the site www.ciprianitartufi.it/ he must examine and accept these conditions of sale before confirming purchases from the site. The forwarding of the order confirmation therefore implies total knowledge of the conditions of sale and their full acceptance. We therefore invite you to read them carefully and to print them and/or save them on another durable medium of your choice, in order to fully satisfy the condition set out in the articles. 3 and 4 of Legislative Decree No. 185/1999 and art.12 legislative decree 9/4/2003 n°70 implementation of Directive 2000/31/EC. The consumer may refuse to access the website or use it if he does not wish to accept and comply with these terms and conditions.
PURCHASE METHOD
2.1 Purchases of the products, available as illustrated and described online in the relevant descriptive sheets, are made at the price indicated therein, expressed in euros including VAT. Transport costs, except in cases expressly indicated or where the system does not charge them, are not included in the price but are displayed separately at the time of purchase. Before confirming your purchase, you will be given a summary of the unit cost of each chosen product, the total cost in the case of multiple products and the related transport costs. By confirming the purchase you will receive an email message containing the date and total amount of your order and the details of the same. We inform you that product availability may vary at any time
ORDERS AND INVOICING
Orders are accepted via electronic selection on the ciprianitartufi.it website. The conclusion of the contract is subject to the Customer paying the entire amount using one of the permitted payment methods.
PURCHASE CONTRACT SIGNED BY MINORS
The purchase can only be made by adults. However, if the purchase occurs by a minor by providing false age information, or false directions to purchase the desired item and/or to access the desired data, the parents or guardians are directly responsible for the payment of what was purchased without prejudice to the withdrawal provisions set out in these conditions of sale.
PAYMENT METHODS
The prices on the ciprianitartufi.it website are inclusive of VAT, containers and packaging.
Payment for the products purchased and the related shipping costs can be made upon sending the order confirmation by using: Paypal circuit or bank transfer, Stripe.
ACCEPTANCE WITH RESERVATION.
If there is no correspondence between the order and the delivery, the Customer must raise the dispute by calling 0571-672185 or by sending an e-mail to customer service at info@ciprianitartufi.it.
HOW TO EXERCISE THE RIGHT OF WITHDRAWAL
Cipriani Tartufi guarantees the right to withdraw from the purchase contract, referring to Legislative Decree 05/22/1999 No. 185 "Implementation of Directive 97/7/EC relating to consumer protection regarding distance contracts" and subsequent amendments.
The Customer can exercise the right of withdrawal (art. 52 of the consumer code) no later than 10 working days from the date of receipt of the goods. This right must be exercised by sending a written communication by registered mail with acknowledgment of receipt to Cipriani Tartufi, Via Fossignano, 63, 04011 Aprilia (LT), Lazio, Italy. The communication can also be sent, within the same deadline, by e-mail addressed to info@ciprianitartufi.it, provided that it is confirmed by registered letter with acknowledgment of receipt within the following forty-eight (48) hours.
The goods must be returned to the Merchant intact, in unaltered conditions and complete with the original packaging, at the Customer's expense no later than 8 days from the Notice of withdrawal. Cipriani Tartufi will re-credit the sums paid (including first shipping costs in the case of total withdrawal from the order) within a maximum of 30 days from the date on which Cipriani Tartufi became aware of the exercise of the right of withdrawal by the Customer and in any case not before having received the return shipment and checked the status of the goods subject to withdrawal. The costs and risks associated with returning the products will be borne by the buyer. It should be noted that community legislation provides that the right of withdrawal can only be exercised by natural persons (consumers) acting for purposes that can be considered unrelated to their commercial activity.
The right of withdrawal, therefore, CANNOT be exercised by legal entities and natural persons acting for purposes related to a commercial activity. Purchases made by resellers or by individuals who in any capacity purchase for resale to third parties are also excluded from the right of withdrawal. The right of withdrawal does not apply to the supply of goods made to measure or clearly personalized or which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly. It is also specified that, in the case of prize operations (the so-called promotions), in which the purchase of a good is combined with another good that is sold at a symbolic price or even given as a gift, the right of withdrawal will be legitimately exercised with the return of both goods which were the subject of the purchase, given the constraint of the accessory nature of the promoted good compared to the first.
For any report, complaint or request for support, you can directly contact info@ciprianitartufi.it quoting the number assigned at the conclusion of the order and reported in the order confirmation sent via e-mail.
LIMITATION OF LIABILITY
Cipriani Tartufi does not assume responsibility for any damage resulting from incorrect use of the service provided by ciprianitartufi.it.
In no case will Cipriani Tartufi, its representatives and its employees, be liable to the User or anyone else.
Cipriani Tartufi assumes no responsibility for errors and omissions within ciprianitartufi.it or any website to which reference or link may be made.
Cipriani Tartufi reserves the right to continuously update the ciprianitartufi.it website which can be carried out at any time. The Information may contain inaccuracies of any kind or typing errors.
Cipriani Tartufi does not guarantee that the services provided by www.ciprianitartufi.it will be provided without interruptions, this will be stated in advance except for reasons beyond the control of Cipriani Tartufi
Cipriani Tartufi is solely responsible for evaluating the accuracy, completeness and usefulness of what is provided via the website www.ciprianitartufi.it
Cipriani Tartufi disclaims any liability to the purchaser or any third party for indirect, incidental, consequential, punitive or exemplary damages (including, but not limited to, loss of profits, revenues, business opportunities) arising out of or in connection with to a product or service provided by Cipriani Tartufi or from the use or inability to use the same.
Cipriani Tartufi assumes no responsibility for disservices attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events which prevent, in whole or in part, from providing execution within the times agreed in the contract. Cipriani Tartufi will not be liable to any party for damages, losses and costs suffered following failure to execute the contract for the causes mentioned above, the Customer having the right only to a refund of the price paid.
8.8 Without prejudice to the cases of willful misconduct or gross negligence of Cipriani Tartufi, it is hereby agreed that, should its liability in any capacity towards the Customer be ascertained, including in the case of total or partial non-performance, to the obligations assumed by Cipriani Tartufi towards the Customer as a result of the execution of an order, the liability of Cipriani Tartufi cannot exceed the price of the Products purchased by the Customer and for which the dispute has arisen.
USER RESPONSIBILITIES
9.1 The User is required to ensure that the data entered is truthful, complete, updated and to promptly communicate any changes to the same. In the event that false declarations are made, the benefits obtained from the services provided will be lost. Cipriani Tartufi reserves the right to delete such subjects from its user lists, after a formal and unaccepted invitation to self-correction.
JURISDICTION
10.1 This contract is governed by the rules of the legal system of the Italian Republic. For any dispute relating to this contract, the Court of Florence has mandatory jurisdiction.
COPYRIGHT AND TRADEMARK
10.2 Given that on the pages of www.tartufi.it it is not intended to voluntarily reproduce any material subject to copyright or in violation of the law; furthermore, given that for any original and protected material published on ciprianitartufi.it the source is cited, in the event of a violation of material subject to copyright being found, whoever holds the same, is required to notify the staff of ciprianitartufi.it ( via e-mail to info@ciprianitartufi.it) who will immediately investigate and resolve, once the situation has been ascertained, by removing such content. It should be noted that each product or product name and its description, each name and related description, company, entity, names of people, trademark, logo mentioned on this site are trademarks or designs belonging to their respective owners or holders and may be protected by patents. and/or copyright granted or registered by the relevant authorities.
